Terms of Service

You must be 21 years of age or older with valid, unexpired government-issued photo identification — or a registered medical cannabis patient (or that patient's registered caregiver) as permitted by CA law. You must be physically located in, and take possession of products in, CA. We do not sell, ship, or deliver cannabis across state lines. You may maintain only one account, in your own legal name. We may refuse service, cancel orders, or close accounts where we reasonably believe these requirements are not met.

Placing an order online is a reservation, not a completed sale. Every order is completed only after in-person verification of your valid government-issued photo ID — at the counter for pickup orders, or at the door for delivery orders. The name on the order must match the name on the ID presented. If valid ID cannot be presented, if the ID does not match the purchaser, or if you appear visibly intoxicated, the order will be refused and cancelled; anything paid online is refunded in full.

All cannabis products are sold by the Dispensary under its state license. Every sale is recorded in the state's cannabis track-and-trace system as required by law. State-mandated purchase limits are enforced automatically at checkout and at handover; we may reduce or cancel any order that would exceed a legal limit.

Prices are in U.S. dollars; applicable taxes are calculated and displayed at checkout. Menu availability is live but not guaranteed — inventory can sell out between placement and fulfillment. If an item becomes unavailable we will contact you to substitute, adjust, or refund. An order is accepted when the Dispensary confirms it and completed at ID-verified handover; we may cancel any order before handover for compliance, inventory, pricing-error, or fraud reasons, with anything already paid refunded in full. Promotions and loyalty rewards are subject to their stated conditions and applicable law.

Pay by Bank (Aeropay). Online bank payments on this Site are processed by Aeropay, Inc. When you choose Pay by Bank you will link a bank account through Aeropay's secure linking flow and verify your identity with a one-time code. By linking an account and paying with Aeropay you agree to Aeropay's Terms of Service and acknowledge Aeropay's Privacy Policy. Your online-banking credentials are provided directly to Aeropay and its bank-connection partners — they are never seen, transmitted, or stored by the Dispensary or RootPoint.

With Pay by Bank, the order total is authorized at placement and charged when the sale is completed at handover. If an order is cancelled before completion, the authorization is released or the charge refunded in full. If your total changes before completion (for example, a substitution you approve), the charged amount will match the final receipt total.

Returned payments. If a bank payment is later returned by your bank, the payment provider manages recovery of those funds directly with you; the Dispensary will not attempt to collect the same amount a second time. Repeated returns may result in Pay by Bank being suspended for your account by the payment provider.

Other payment methods (such as cash, debit, gift cards, or store credit) may be available at pickup or delivery as displayed at checkout, subject to state rules. Delivery orders may be required to be paid online at the time of ordering.

Pickup: bring the ID matching the order. Orders not collected within the hold window shown at checkout may be cancelled and refunded. Delivery (where offered) is available only to eligible addresses within CA service areas permitted by law. The person named on the order must personally accept it, present valid matching ID, and must not be visibly intoxicated. Deliveries cannot be left unattended, given to another person, or made to prohibited locations. If a delivery cannot be lawfully completed, the products are returned to the store and the order refunded per Section 5. Delivery windows are estimates.

Because cannabis is a regulated product, returns are limited by law. We accept returns of defective or incorrectly fulfilled products — contact us with your receipt or order number. Approved refunds are issued to the original payment method or as store credit where the law allows. Products confirmed accurate and non-defective at handover are otherwise not returnable. Statutory rights are unaffected.

Potency values (THC, CBD, and other cannabinoids) come from state-required laboratory testing of each batch and may vary within legal tolerances from the values shown. Cannabis products may cause intoxication and impairment — do not operate a vehicle or machinery under the influence. There may be health risks associated with consumption, including for pregnant or breastfeeding women. Keep out of reach of children and pets. Nothing on the Site is medical advice; statements have not been evaluated by the Food and Drug Administration, and products are not intended to diagnose, treat, cure, or prevent any disease.

You agree not to: resell or redistribute any product purchased through the Site; purchase for, or transfer products to, any person under 21 (or any non-patient, for medical orders); misrepresent your identity or age; interfere with or attempt to bypass the Site's security, purchase limits, or compliance controls; or use the Site for any unlawful purpose. Violations result in account termination and may be reported to authorities where the law requires.

You are responsible for the accuracy of your account details and the security of your login. By providing your email or phone number you consent to receive transactional messages about your orders. Marketing messages are sent only with your separate consent, and every one includes an opt-out. Message and data rates may apply.

The Site, its software, design, and content are the property of RootPoint and its licensors, or of the Dispensary and brand owners. You may use the Site for personal, non-commercial shopping only; no scraping, copying, or derivative use without written permission.

The Site is provided “as is” and “as available.” To the fullest extent permitted by law: we disclaim all warranties not expressly stated here; neither the Dispensary nor RootPoint is liable for indirect, incidental, special, or consequential damages arising from use of the Site; and the total aggregate liability of the Dispensary and RootPoint for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited under applicable law.

You agree to indemnify and hold harmless the Dispensary, RootPoint, and their officers, employees, and agents from claims arising out of your violation of these Terms or applicable law — including any transfer of purchased products to a third party.

These Terms are governed by the laws of the state of CA, without regard to conflict-of-law rules, and disputes will be resolved in the courts located there.
